Peter Rawlings Takes Up the Issue of Striking Workers and Unemployment Benefits

The NYU Journal of Legislation and Public Policy published Peter Rawling’s article about federal labor law preemption and the payment of unemployment benefits to striking workers in its November 2025 edition. The article provides an overview of how many states don’t provide striking workers with unemployment benefits or make them wait longer to receive benefits than workers who are unemployed for other reasons. For example, in New York and New Jersey, striking workers must wait 14 days to receive unemployment benefits. Peter makes the argument that striking workers should be paid unemployment insurance promptly, just like any other worker, and that federal preemption doctrines ought not prevent them doing so.
